O-1 Visa Evidence Checklist: Documents You Need

The documents an O-1 petition needs: forms, advisory opinion, contract, itinerary, letters and the evidence for each O-1A and O-1B criterion.

Page reviewed October 8, 2026.

What documents does an O-1 petition need?

An O-1 petition has two layers: a filing package and evidence that you meet the criteria.

The first is the filing package: Form I-129 with the O and P Classifications Supplement, a written advisory opinion (the consultation), a contract or a summary of an oral agreement, an itinerary or explanation of the events, and any support letters. The second is the evidence that you meet the criteria. For the O-1A you show a major internationally recognized award or at least three of eight criteria. For the O-1B in the arts you show a significant award or at least three of six. A U.S. employer or U.S. agent files the petition, because an O alien may not petition for themselves.

What does the O-1 filing package contain?

The consultation, contract and itinerary are required by 8 CFR 214.2(o)(2) and (o)(5). Each row lists a mistake that can lead to a request for evidence or a delay.

ItemWho supplies itCommon mistake
Form I-129 and the O and P Classifications Supplement. The supplement asks for the classification, the nature of the event, the duties and whether the consultation is attached. O-1A petitions also need the export control certification in Part 6 of the I-129.The petitioner: a U.S. employer, a U.S. agent, or a foreign employer through a U.S. agentFiling too early. A petition may not be filed more than one year before the actual need, and USCIS advises filing at least 45 days before the date of employment.
Consultation (advisory opinion). A written opinion from a peer group, a labor or management organization, or an expert. It is mandatory for O-1 petitions. The petitioner obtains itLeaving out the watermarked original. USCIS asks for the version containing the watermark. An unfavorable opinion must also set out a specific statement of facts.
Contract, or a summary of the terms of an oral agreement. The summary states the terms offered and the terms accepted. It does not need to be signed by both parties. The employer or the agentSubmitting nothing because there is no formal contract. Emails and other records can show an oral agreement.
Explanation of the events or activities, with start and end dates and an itineraryThe petitionerVague dates. Work in more than one location needs an itinerary with dates and places.
Agent agreement, only when an agent files. An agent acting for multiple employers also needs a complete itinerary and the contracts. The agentNo proof that the other employers authorized the agent.
Support letters. A letter must describe your recognition and ability in factual terms and set out the writer's expertise and how the writer knows what is stated.Employers and independent expertsGeneric praise with no stated basis of knowledge, which USCIS treats as less persuasive.
Certified English translations of any foreign-language documentYou or the petitionerA translation without the translator's certification, signature and contact details.

What evidence does the O-1A need?

The O-1A is for extraordinary ability in the sciences, education, business or athletics. Show a major internationally recognized award, or at least three of these:

  • Awards: nationally or internationally recognized prizes or awards for excellence in the field.
  • Membership: associations that require outstanding achievement of their members.
  • Published material about you: in professional or major trade publications or major media, showing the title, date and author. USCIS looks for coverage focused on you and your work.
  • Judging: peer review, dissertation committees or grant panels. Show that you completed the review.
  • Original contributions of major significance: patents, citations, commercial use and expert letters.
  • Scholarly articles: you must be a listed author.
  • Critical or essential role at an organization with a distinguished reputation: for example a founder role at a funded company or a principal investigator role.
  • High salary or other remuneration compared with others in the field: contracts, tax records and wage surveys.

What evidence does the O-1B in the arts need?

The O-1B is for extraordinary ability in the arts. Show nomination for or receipt of a significant national or international award, or at least three of these:

  • A lead or starring role in productions or events with a distinguished reputation: reviews, advertisements and contracts.
  • National or international recognition shown by critical reviews or other published material in major publications.
  • A lead, starring or critical role for organizations with a distinguished reputation.
  • A record of major commercial or critically acclaimed success: box office, ratings, sales or reviews.
  • Significant recognition from organizations, critics, government agencies or other experts. A testimonial must show the author's authority.
  • A high salary or other remuneration compared with others in the field.

Which three points apply to every case?

  • Meeting the criteria is the first step, not the last. USCIS then weighs the evidence as a whole, so meeting three criteria does not by itself establish eligibility.
  • Comparable evidence is allowed only when a listed criterion does not readily apply to your field. You still need three criteria.
  • The petition needs a U.S. petitioner. A U.S. employer, a U.S. agent or a foreign employer through a U.S. agent can file. Lando can act as the agent petitioner where the rules allow it.

How it works

From first call to filed petition

  1. 1. Evaluation

    You get an honest answer.

We review your background on a 15-minute call and tell you honestly whether you have a strong case, and exactly what evidence would make it stronger. No retainer. No commitment.

  2. 2. Strategy

You know exactly what your case looks like.

We build your custom evidence map: which achievements to lead with, which expert letters to commission, and which USCIS criteria your background meets. You see the full picture before we file anything.

  3. 3. Preparation

Your petition is built without you lifting a finger.

Our team writes your expert support letters, drafts the legal brief, curates every exhibit, and reviews the full petition before it leaves our hands. You approve. We file.

  4. 4. Filing

Filed. You get on with your life.

Your petition is filed at USCIS and we manage every communication from there. For the O-1, filing can take about two weeks once your documents are ready. We handle any RFE at no extra charge.

Common questions

How many criteria do I need for an O-1?

For the O-1A, at least three of eight criteria or a major internationally recognized award. For the O-1B in the arts, at least three of six or a significant national or international award. Meeting three does not guarantee approval, because USCIS then weighs all the evidence together.

Is the advisory opinion required?

Yes, a consultation is required for O-1 petitions. A petitioner may show that no appropriate peer group exists, or, for arts petitions, request a waiver within two years of an earlier consultation. The opinion is advisory, and an unfavorable one is not an automatic denial.

Can I file an O-1 petition for myself?

No. An O alien may not petition for themselves. A U.S. employer, a U.S. agent or a foreign employer through a U.S. agent must file. A company you own can file for you, and an agent can file where the rules allow.

Do I need a written contract?

Provide a written contract if one exists. If it does not, provide a summary of the terms of the oral agreement, stating what was offered and what was accepted. The summary does not need to be signed by both parties.

How long does O-1 status last?

The initial period covers the time needed for the event or activity, up to three years. Extensions come in increments of up to one year, with no fixed limit on the number of extensions.

Does Lando guarantee approval?

No. USCIS decides every petition, and Lando does not promise an outcome. Lando is not a law firm. Petitions are prepared in coordination with licensed U.S. immigration attorneys.
