O-1 Visa Duration and Extension: How Long It Lasts

How long an O-1 visa lasts: the initial stay of up to three years, one-year extensions, visa validity versus period of stay, and when a new petition is needed.

Page reviewed October 8, 2026.

Quick answer. An initial O-1 stay can be up to three years, covering the time needed to complete the event or activity in the petition. It can then be extended. An extension to continue the same activity is granted in increments of up to one year, and an extension based on a new event or activity can run for the time needed, up to three years. An extension is requested before the current petition expires. The visa stamp in your passport and your authorized period of stay are not the same thing, and the period of stay is what counts for how long you can remain in the United States.

How long an O-1 lasts

  • The initial period of stay can be up to three years, for the time needed to complete the event or activity described in the petition.
  • An extension to continue or complete the same event or activity is granted in increments of up to one year. An extension based on a new event or activity can run for the time needed, up to three years.
  • USCIS policy sets no limit on the number of extensions it may approve for the same person.
  • The O-1 has no annual cap and no lottery, so there is no yearly window you can miss.
  • O-1 holders may generally be admitted up to 10 days before the period starts and stay up to 10 days after it ends. These days are not for working.

Visa validity is not the same as your period of stay

The visa stamp is an entry document issued by a consulate. It has its own expiry date. Your period of stay is the time USCIS approved on the petition and records on your Form I-94. A stamp can expire while your approved stay continues. You only need a valid stamp to enter the United States again, not to remain here.

How an extension works

  • The petitioner files Form I-129 with USCIS, with a copy of your Form I-94 and a statement explaining why the extension is needed. You cannot file for yourself, although a company you own can.
  • File before the current petition expires. A petition extension generally can be filed only while the original is still valid, and you must be in the United States when the extension of stay is filed.
  • For the same activity, the statement describes the event or activity behind the original approval and confirms the extension is needed to continue or complete it. A new activity needs fresh evidence of that activity.
  • Premium processing is optional for an extra USCIS fee, and USCIS then takes action within 15 business days: an approval, a request for evidence or a denial.
  • USCIS fees are separate from the service fee. See the fee calculator for the current amounts.

When you need a new or amended petition

  • A change of employer needs a new petition from the new employer, with a request to extend your stay. If an agent filed the original, an amended petition is filed with evidence about the new employer.
  • A material change in the terms and conditions of employment, or in your eligibility, needs an amended petition. An artist or entertainer can add performances or engagements during the validity period without amending, if they still need O-1 caliber.
  • A new event or activity can be the basis for an extension of up to three years, supported by evidence of that new activity.

Staying longer than the O-1 allows

The O-1 is a temporary status, but it can be extended while the work continues. Some O-1 holders later look at a green card. The EB-1A uses the same kind of evidence and is the common route.

Common questions

How long is an O-1 visa valid?

The initial period of stay can be up to three years. An extension for the same activity is granted in increments of up to one year, and an extension for a new activity can be up to three years. The visa stamp has its own expiry date and is separate from your approved period of stay.

Can the O-1 visa be extended?

Yes. The petitioner files Form I-129 before the current petition expires, with a copy of your Form I-94 and a statement explaining why the extension is needed.

Is there a maximum number of O-1 extensions?

No. USCIS policy says there is no limit to the number of extensions of stay it may approve for the same person. Each extension still has to be supported by the same activity continuing or by a new activity.

What is the difference between visa validity and period of stay?

Validity is how long the visa stamp can be used to enter the United States. The period of stay is how long USCIS approved you to remain, recorded on your I-94.

Do I need a new petition if I change employers?

Yes. The new employer files a petition with a request to extend your stay. If an agent filed the original petition, an amended petition is filed with evidence about the new employer.
