H-1B to O-1: How to Switch and When It Makes Sense
Can you switch from H-1B to O-1? How a change of status works, what changes (petitioner, evidence, limits), and when the O-1 is a better fit than the H-1B.
Page reviewed October 8, 2026.
Quick answer. Yes. An H-1B worker who meets the O-1 standard can move to the O-1 through a change of status petition filed on Form I-129, without leaving the United States. The O-1 has no annual cap or lottery, it is not limited to six years, and an agent can file where you work for several clients. The petition must show a major award or at least three criteria, so eligibility, not H-1B status, is what decides it.
Can you switch from H-1B to O-1?
Yes, if you can show extraordinary ability in your field. The petitioner, which can be a U.S. employer or a U.S. agent, files Form I-129 asking USCIS to change your status from H-1B to O-1. You stay in the United States while it is decided, and you keep your H-1B status until the change is approved.
Why H-1B workers look at the O-1
- No lottery and no annual cap. The O-1 is not subject to the H-1B cap.
- No fixed six-year ceiling. O-1 extensions are granted in increments of up to one year.
- More flexibility. An agent can file where you work for several clients, instead of one employer.
- A route that does not depend on the specialty-occupation test.
What changes when you switch
- The standard. The H-1B asks about the job and your degree. The O-1 asks about your acclaim, shown through awards or at least three criteria.
- The petitioner and the work. The O-1 relates to the petitioner and the work described in the petition, so other employment generally needs its own petition.
- The paperwork. An O-1 petition needs an advisory opinion (consultation) and an itinerary or description of the work.
- Dependents. Your spouse and children move from H-4 to O-3, which does not allow employment.
How the change of status works
- Check eligibility: awards, press, judging, original contributions, critical roles, high salary and the other O-1 criteria.
- Choose the petitioner: your employer, or a U.S. agent if you work across clients.
- Prepare and file Form I-129 with the evidence, advisory opinion and contracts or itinerary.
- Optionally request premium processing, where USCIS takes action within 15 business days of receiving the request.
- Keep your H-1B status valid until USCIS approves the change. After approval you work under the O-1.
When the O-1 is not the right move
If your record does not yet meet the O-1 standard, switching now is premature. The free evaluation shows which criteria you could meet and what to build first. Many H-1B workers are closer than they expect, because publications, press, judging and senior roles from their H-1B years count.
Common questions
Can I change from H-1B to O-1 without leaving the U.S.?
Yes. A change of status petition on Form I-129 can move you from H-1B to O-1 while you stay in the United States. You keep your H-1B status valid until the change is approved.
Is the O-1 subject to the H-1B cap or lottery?
No. The O-1 has no annual cap and no lottery.
Does the six-year H-1B limit apply to the O-1?
No. The O-1 is granted for an initial stay of up to three years, with extensions in increments of up to one year, and there is no six-year ceiling.
Do I need my H-1B employer to file the O-1?
Not necessarily. The petition can be filed by a U.S. employer or by a U.S. agent, so you can use an agent if you work for several clients or your employer will not file. Lando can act as your U.S. agent where the rules allow.
Can my H-4 spouse work after I switch to O-1?
No. Your spouse and unmarried children under 21 move to O-3 status, which does not allow employment.
How long does an H-1B to O-1 change take?
Preparation varies by case. With premium processing, USCIS takes action within 15 business days of receiving the request, and Lando's average time to a filed petition is about two weeks.
