EB-1A vs EB-2 NIW: Key Differences

EB-1A vs EB-2 NIW compared: the standard, the criteria, job offer rules, self-petitioning and what evidence each one needs.

Page reviewed October 8, 2026.

How is the EB-1A different from the EB-2 NIW?

Under 8 CFR 204.5(h), the EB-1A asks whether you have sustained acclaim and are at the very top of your field, shown by a one-time major award or three of ten criteria and then a final review of all the evidence.

The EB-2 national interest waiver asks whether your proposed endeavor has substantial merit and national importance, whether you are well positioned to advance it, and whether waiving the job offer benefits the United States. Both can be self-petitioned. Neither is an easier version of the other.

How do the EB-1A and EB-2 NIW compare?

Premium processing is available for these classifications, and the I-485 can be filed at the same time as the I-140 only when the Visa Bulletin chart allows it. Check the current Visa Bulletin and the USCIS premium processing page, because both change.

What are the three NIW prongs under the USCIS Policy Manual?

The endeavor has to be more specific than a general occupation. Qualifying for EB-2 does not automatically mean qualifying for the waiver.

  1. The proposed endeavor has substantial merit and national importance.
  2. The person is well positioned to advance the proposed endeavor.
  3. On balance, it would be beneficial to the United States to waive the job offer and labor certification requirements.

What mistakes do EB-1A and NIW filers make?

  1. Treating the NIW as an easier EB-1A. It has its own three prongs.
  2. Assuming an advanced degree wins the waiver.
  3. Describing a job title instead of a specific endeavor.
  4. Stopping at three EB-1A criteria without preparing for the final review.
  5. Making generic job-creation claims for a founder. Not every entrepreneur qualifies.
  6. Skipping proof that you intend to continue work in your field.

Can you file both?

The sources we reviewed treat each classification on its own terms and do not say whether filing both together is allowed or advisable. That is a question for a licensed immigration attorney who has seen your record.

Filed. You get on with your life.

Your petition is filed at USCIS and we manage every communication from there. For the O-1, filing can take about two weeks once your documents are ready. We handle any RFE at no extra charge.

Common questions

Does the EB-1A need a job offer?

No. USCIS states that no offer of employment or labor certification is required. The petition must still show clear evidence that the person is coming to continue work in their area of expertise.

Can I file an NIW petition myself?

Yes. The Policy Manual says an NIW petition does not need a job offer, so the person may file as a self-petitioner. You must still qualify for EB-2 first, as an advanced degree professional or a person of exceptional ability.

What are the three NIW prongs?

The endeavor has substantial merit and national importance, the person is well positioned to advance it, and on balance it benefits the United States to waive the job offer and labor certification. USCIS weighs them as a matter of discretion.

How many EB-1A criteria must I meet?

Either a one-time major, internationally recognized award or at least three of ten listed criteria. Meeting three is only step one. USCIS then reviews all the evidence together in a final merits determination of sustained acclaim.

Can I file the green card application with the I-140?

Sometimes. USCIS allows concurrent I-485 filing only when a visa is immediately available under the Visa Bulletin chart it directs applicants to use. Check the current bulletin before planning around it.

Does Lando guarantee approval?
