The framing approach most likely to succeed with a moderate citation record is to combine citation analysis with adoption documentation: evidence that organizations or researchers specifically modified their methods in response to the petitioner's patent, rather than merely citing it as prior art in a defensive filing. Product announcements by companies whose technology builds on the petitioner's patent, academic publications that use the petitioner's method as a research tool and cite the underlying patent as the source of the technique, or regulatory submissions that reference the petitioner's method as the standard approach in a technical domain all support the major significance showing by demonstrating real-world adoption beyond the formal citation record.

Petitioners who anticipate building an O-1A case around patent citation impact should begin tracking citation growth and adoption indicators at least eighteen months before filing, so that the evidence record reflects a complete picture of the contribution's trajectory rather than a snapshot of a single moment. Citation counts grow over time, and a patent that has been cited fifty times at the time of filing may have been cited twenty-five times a year earlier. Documenting citation growth over time—showing that subsequent researchers continue to engage with the contribution as the field develops—provides an additional evidence layer that a static point-in-time citation exhibit cannot supply.

Building and auditing the patent citation file
