# O-1A Visa for Doctors and Scientists

How physicians and scientists qualify for the O-1A: citations, peer review, grants, a critical role, pay and the clinical-work question.

Page reviewed October 8, 2026.

Can a physician or scientist qualify for the O-1A?

A physician or scientist can qualify for the O-1A by showing sustained acclaim at the top of the field: a major internationally recognized award, or at least three of eight criteria, followed by a review of all the evidence together.

Researchers usually rely on scholarly articles, original contributions, judging and a critical role. For clinicians the work in the United States has to continue the area of acclaim, which for a physician may be research, a specialty or a program you built.

CapNo capNo lottery, and it can be filed when your evidence is ready.

First stayUp to 3 yearsFor the time needed to complete the event or activity.

Extensions1-year stepsUSCIS policy sets no limit on their number.

FamilyO-3 statusSpouses and children cannot work on O-3.

## How do the eight criteria apply to medicine and science?

| Criterion | What the evidence can look like | What USCIS looks for |
| --- | --- | --- |
| Awards | National or international prizes, doctoral dissertation awards, awards for conference presentations | Recognition beyond one school, employer or locality |
| Membership | Fellowships and professional associations | Admission that requires outstanding achievement judged by experts |
| Published material about you | Coverage of you and your research in professional or major media | The title, date and author, and a focus on you and your work |
| Judging | Journal peer review, abstract review, dissertation committees, grant review panels | Proof that you completed the review, not only the invitation |
| Original contributions of major significance | Citations, publication in a distinguished journal, patents, commercialization of a research result, expert letters | Evidence of major significance. A funded grant or a publication alone is not necessarily enough. |
| Scholarly articles | Peer-reviewed papers and published conference presentations | A listed author. You do not need to be first author, and no citation count is needed to meet this criterion. |
| Critical or essential role | A faculty or research position at a distinguished department, a principal or named investigator on a merit-based grant | Your duties and performance compared with others in similar roles, not the prestige of the institution alone |
| High salary | Pay statements and compensation surveys | A comparison with others in the field |

## How do citations and grants fit into the record?

- A high citation rate or h-index relative to others in your field can show that you are among the small percentage at the top. USCIS publishes no numeric cutoff, so bring comparison data for your field.
- USCIS may give particular weight to publication in highly ranked journals, especially if you are the most significant contributor, a senior author or the sole author.
- Being a named investigator on a peer-reviewed, competitively funded U.S. government STEM grant is a positive factor. A grant by itself does not prove significance, so list your actual role and the type of award.
- Employment at a leading research institution and unsolicited invitations to speak are also positive factors in the overall review.
- Letters should describe your contribution and its significance in specific terms and set out the writer's expertise and how the writer knows what is stated. Generic praise with no stated basis of knowledge is less persuasive.

## What should clinicians know?

The petition must show that you are coming to continue work in the area of your extraordinary ability. The duties do not have to require someone of extraordinary ability, but they do need to connect to the area of acclaim. For a physician, that may be research, a specialty or a clinical program you built. A job description that does not match the area of acclaim is a common problem.

Lando does not advise on medical licensure, residency matching, waiver programs or immigration legal strategy; ask a licensed attorney. Those are separate questions for the relevant licensing bodies and counsel.

## Which weaknesses in a scientist's record might USCIS question?

- Citation counts with no benchmark for your field.
- Journal articles with no showing of the journal's standing.
- Local or institutional awards, fellowships and scholarships presented as national recognition.
- Peer review claimed from invitation emails only.
- Grants listed without the role, the award type or the competition behind them.
- A trainee position presented as a critical role without duties and results.
- A clinical job description that does not match the area of acclaim.
- Generic letters.

## Who files a physician or scientist petition, and who writes the opinion?

- A U.S. employer, such as a university, hospital or research institute, or a U.S. agent can file the petition. You cannot file for yourself, and the position on the contract has to continue your area of acclaim.
- A written advisory opinion is required, from a U.S. peer group, such as a professional society in your specialty, or a person with expertise in your field, or a letter of no objection. It is advisory. The two-year arts waiver does not apply to the O-1A.
- The initial approval period is up to three years, with extensions in increments of up to one year.

How it works

## From first call to filed petition

- 1. Evaluation

### You get an honest answer.

We review your background on a 15-minute call and tell you honestly whether you have a strong case, and exactly what evidence would make it stronger. No retainer. No commitment.
- 2. Strategy

### You know exactly what your case looks like.

We build your custom evidence map: which achievements to lead with, which expert letters to commission, and which USCIS criteria your background meets. You see the full picture before we file anything.
- 3. Preparation

### Your petition is built without you lifting a finger.

Our team writes your expert support letters, drafts the legal brief, curates every exhibit, and reviews the full petition before it leaves our hands. You approve. We file.
- 4. Filing

### Filed. You get on with your life.

Your petition is filed at USCIS and we manage every communication from there. For the O-1, filing can take about two weeks once your documents are ready. We handle any RFE at no extra charge.

## Common questions

Can a physician get an O-1A visa?+

Yes, if the physician shows sustained acclaim at the top of the field and is coming to continue work in that area. The duties do not have to require someone of extraordinary ability, but they must continue the area of acclaim. You need a major award or three of eight criteria, and then USCIS reviews all the evidence.

Do citations and h-index matter?+

They matter as comparative evidence. USCIS says a high citation rate or h-index relative to others in the field may show that a person is among the small percentage at the top. No numeric cutoff is published.

Does peer review count?+

Yes, as judging the work of others. Journal peer review, abstract review, dissertation committees and review for government funding programs are examples. You must show the review was completed, not only that you were invited.

Do research grants help?+

Yes. Being a principal or named investigator on a merit-based government award can support a critical role, and a competitively funded U.S. government STEM grant is a positive factor. A grant alone does not prove significance.

Is a postdoc or fellowship enough?+

Not by itself. Employment at a leading institution is a positive factor, but each criterion needs its own evidence. A fellowship is considered for the membership criterion only if admission requires outstanding achievement judged by recognized experts.

Who writes the advisory opinion for a scientist?+

A U.S. peer group in the field or a person with relevant expertise, as a signed written opinion, or a letter of no objection. It is submitted with the petition and is advisory, not binding on USCIS.

Does Lando guarantee approval?+

No. USCIS decides every petition, and Lando does not promise an outcome. Lando is not a law firm. Petitions are prepared in coordination with licensed U.S. immigration attorneys.
