# O-1 vs P-1 Visa: Which One Fits

O-1 vs P-1: who qualifies, individual or group, how long each lasts, who files, and which fits a solo artist, athlete or band.

Page reviewed October 8, 2026.

What is the difference between the O-1 and the P-1?

Under 8 CFR 214.2(o) and (p), use the O-1 for an individual with extraordinary ability or achievement.

Use the P-1A for an internationally recognized athlete or team, the P-1B for a member of an internationally recognized entertainment group, and the P-2 for a reciprocal exchange program. A solo performer cannot use the P-1B, so the O-1B is the individual route. The O-1 cannot be filed by the beneficiary personally. Both need a consultation.

CapNo capNo lottery, and it can be filed when your evidence is ready.

First stayUp to 3 yearsFor the time needed to complete the event or activity.

Extensions1-year stepsUSCIS policy sets no limit on their number.

FamilyO-3 statusSpouses and children cannot work on O-3.

## How do the O-1, P-1A, P-1B and P-2 compare?

The P classifications define internationally recognized as a high level of achievement evidenced by skill and recognition substantially above that ordinarily encountered, to the extent that it is renowned, leading or well-known in more than one country. The O-1 does not use that definition.

| Item | O-1A / O-1B | P-1A | P-1B | P-2 |
| --- | --- | --- | --- | --- |
| Who | Individual with extraordinary ability (O-1A) or distinction in the arts or extraordinary achievement in film and TV (O-1B) | Internationally recognized athlete or team | Member of an internationally recognized entertainment group | Artist or entertainer, alone or in a group, under a reciprocal exchange program |
| Individual or group | Individual. Only one beneficiary on an O-1 petition | Individual or team | Group, performing as a unit. Not for a solo entertainer | Individual or group |
| Initial period | Up to 3 years | Up to 5 years for an individual athlete, up to 1 year for a team | Up to 1 year | Up to 1 year |
| Consultation | Peer group, labor or management organization | Labor organization | Labor organization | Labor organization verifies the exchange program |
| Who files | U.S. employer, U.S. agent or foreign employer through a U.S. agent. The beneficiary cannot petition personally | U.S. employer, sponsoring organization or agent | Same as P-1A | U.S. labor organization, sponsoring organization or employer |

## Which one fits a solo artist, a band or an athlete?

- Solo musician, actor, dancer or visual artist: the O-1B in the arts. The P-1B is not appropriate for a solo entertainer.
- A band or ensemble that performs as a unit: the P-1B can fit, subject to the group rules. A solo artist's backing group may be classified as a group if it meets the requirements. If it does not, the artist may need the O-1 and the backing group the O-2.
- A professional athlete or a team in an international competition: the P-1A. An athlete can also look at the O-1A when the record fits the O-1A criteria better.
- An exchange between a U.S. and a foreign organization: the P-2, where a formal reciprocal exchange agreement exists.

## What are the P-1B group rules?

- The group is evaluated as a unit, and a member cannot perform separate and apart from it.
- At least 75 percent of the members must have had a relationship with the group for at least one year, with exceptions the regulation sets out. The group must have been established for a period of time.
- A P petition can name several beneficiaries on one filing, up to the limit in the regulation.

## What mistakes do O-1 and P filers make?

- Filing a P-1B for a solo performer.
- Ignoring the 75 percent and one-year group rule.
- Assuming a P-1A athlete needs only a team contract. The competition must have a distinguished reputation and be at an international level.
- Applying the individual athlete's five-year period to teams and groups, which get up to one year.
- Treating the consultation as an O-1 requirement only. The P classifications require a labor organization consultation too.
- Filing an O-1 for yourself. The regulation says an O alien may not petition for himself or herself. A U.S. agent, or in some cases a separate entity the beneficiary owns, can file.

How it works

## From first call to filed petition

- 1. Evaluation

### You get an honest answer.

We review your background on a 15-minute call and tell you honestly whether you have a strong case, and exactly what evidence would make it stronger. No retainer. No commitment.
- 2. Strategy

### You know exactly what your case looks like.

We build your custom evidence map: which achievements to lead with, which expert letters to commission, and which USCIS criteria your background meets. You see the full picture before we file anything.
- 3. Preparation

### Your petition is built without you lifting a finger.

Our team writes your expert support letters, drafts the legal brief, curates every exhibit, and reviews the full petition before it leaves our hands. You approve. We file.
- 4. Filing

### Filed. You get on with your life.

Your petition is filed at USCIS and we manage every communication from there. For the O-1, filing can take about two weeks once your documents are ready. We handle any RFE at no extra charge.

## Common questions

Is the O-1 or the P-1 right for a solo musician?+

The O-1B in the arts. USCIS says the P-1B is not appropriate for a person performing as a solo entertainer. A backing group may qualify as a P-1B group if it meets the group requirements.

Which lasts longer?+

The O-1 is granted for up to three years initially. A P-1A individual athlete can receive up to five years. A P-1B group, a P-1A team and the P-2 are up to one year.

Do both need a union or peer opinion?+

Yes. The O-1 needs a consultation from a peer group, labor or management organization. The P classifications need a labor organization consultation. Both can be excused if no appropriate organization exists.

Can I file for myself?+

Not under the O-1. The regulation says an O alien may not petition for himself or herself, though a U.S. agent can file. P petitions are filed by an employer, sponsoring organization or agent.

What does internationally recognized mean for the P-1?+

It means skill and recognition substantially above that ordinarily encountered, to the extent the achievement is renowned, leading or well-known in more than one country, as defined in 8 CFR 214.2(p).

Does Lando guarantee approval?+

No. USCIS decides every petition, and Lando does not promise an outcome. Lando is not a law firm. Petitions are prepared in coordination with licensed U.S. immigration attorneys.
