# O-1 Visa Spouse and Children: O-3 Dependents

O-3 status for the spouse and unmarried children under 21 of an O-1 holder: who qualifies, what O-3 allows, whether they can work, and how to apply.

Page reviewed October 8, 2026.

**Quick answer.** The spouse and unmarried children under 21 of an O-1 holder may be eligible for O-3 status. O-3 lets them live in the United States with the O-1 holder for as long as the O-1 holder's status lasts. O-3 does not give permission to work in the United States. Children can attend school.

## Who can get O-3 status

- The spouse of an O-1 holder.
- Unmarried children of an O-1 holder who are under 21.
- Support staff on an O-2 are a different category and have their own rules.

## What O-3 allows and what it does not

- It allows the family to live in the United States while the O-1 holder is in status.
- It does not allow the spouse to work in the United States.
- Children may attend school.
- The O-3 period follows the O-1 holder's period. If the O-1 ends or is not extended, the O-3 ends with it.

## How the family applies

- Family members outside the United States generally apply for an O-3 visa at a U.S. consulate, with proof of the relationship to the O-1 holder.
- Family members already in the United States in a valid status may be able to change status by filing Form I-539 with USCIS.
- Family members who need more time file Form I-539 to extend their stay.
- USCIS fees apply to each family member who files. They are separate from the service fee.

## A spouse who wants to work

O-3 status does not allow work. A spouse who wants to work in the United States needs a classification of their own, which can be an O-1 if their record supports it, or another work visa. This is a separate case with its own evidence.
