# H-1B Lottery Alternatives: Visas With No Lottery

Not selected in the H-1B lottery? The main alternatives: the O-1 (no cap or lottery), cap-exempt employers, L-1, TN and green card routes, and who each one suits.

Page reviewed October 8, 2026.

**Quick answer.** The H-1B is limited by an annual cap, so selection is by lottery. Alternatives include the O-1 for people with extraordinary ability (no cap and no lottery), H-1B jobs at cap-exempt employers such as universities and affiliated nonprofits, the L-1 for intracompany transfers, the TN for eligible Canadian and Mexican professionals, and employment-based green cards. Which one fits depends on your record and your employer.

## Why the H-1B has a lottery

Congress limits how many new H-1B visas can be issued each year, with a regular cap and an additional allocation for people with a U.S. master's degree or higher. When registrations exceed the cap, USCIS selects them at random. Fees and rules for the H-1B have also been changing, so check USCIS for the current requirements before planning around it.

## The O-1: no cap, no lottery

The O-1 is for people with extraordinary ability or achievement, shown by a major award or at least three criteria. It has no annual cap and no lottery, and a U.S. agent can file where you work for several clients.

## Other routes to consider

- Cap-exempt H-1B: universities, affiliated nonprofits and some research organizations can file H-1B petitions without being subject to the cap.
- L-1: for employees transferring to a U.S. office of the same company after working for it abroad.
- TN: for eligible Canadian and Mexican professionals in listed occupations.
- Employment-based green cards: routes such as the EB-1A for extraordinary ability, which do not depend on the H-1B.

## How to choose

Start from your record, not the visa. If you have awards, press, judging, original contributions, critical roles or high pay in your field, the O-1 may fit without any lottery. If your strength is a specific job offer in a specialty occupation, the H-1B or a cap-exempt employer may. Lando's free evaluation shows which O-1 criteria you could meet and what to build first.

## Common questions

### Is there a lottery for the O-1 visa?

No. The O-1 has no annual cap and no lottery.

Universities and affiliated nonprofits, and some nonprofit and governmental research organizations, can file H-1B petitions without being subject to the cap. Check USCIS for the current definitions.

### Do H-1B fees affect the O-1?

No. H-1B fees apply to H-1B petitions. The O-1 has its own USCIS filing fees, which you can calculate with the USCIS fee calculator.
