For researchers transitioning to private sector roles, the critical role criterion must also be satisfied in the prospective employment, not just in the prior federal position. An O-1A petition is filed for the new employer; evidence of critical role should include the new employer's organizational structure, a description of what the petitioner will lead or be responsible for, and documentation of the employer's distinguished reputation in its private sector context. A biotech company with multiple FDA-approved products, a defense contractor on a major government prime contract, or a consulting firm with recognized technical authority in a regulated industry can all establish distinguished reputation through documentation the petition supplies.
